Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Healther application (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Php4u Limited (“Healther”, “we”, “us”, or “our”).

2. Description of Service

Healther is a mobile application that allows you to:

• Scan food product barcodes using your device camera
• Identify food products from photos using AI (Google Gemini Vision via Firebase Cloud Functions)
• View NutriScore (A–E nutritional quality rating) and NOVA group (1–4 ultra-processing classification) for scanned products
• Detect the 14 major EU allergens, as well as vegan, vegetarian, and palm-oil status
• View additive (E-number) information and ingredient percentage breakdowns
• Receive an AI-generated personalised health verdict (good, moderate, or poor) based on the product’s data and your personal Avoid and Trust lists
• See "Watch Out" alerts when a scanned product matches an item on your Avoid list
• Discover healthier product alternatives with a lower NutriScore
• Manage personalised Avoid and Trust lists covering ingredients, allergens, brands, countries of origin, and specific products
• Browse your recent scan history on the home screen, with NutriScore and NOVA filtering
• Upgrade to Healther Pro to remove in-app advertising
• Use the app in English, Spanish, French, German, or Polish

The Service is provided free of charge with optional premium features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

4. Data Accuracy

Product nutrition data is sourced from Open Food Facts, a community-maintained open database. This means:

• Product data may be incomplete, outdated, or contain errors submitted by contributors.
• Healther does not independently verify or validate nutritional information sourced from Open Food Facts.
• AI-identified products (from uploaded or captured photos) are best-effort estimates and may not always be correct.
• NutriScore and NOVA classifications are calculated from the available product data and are subject to the same limitations.

Always consult official product labelling and, where relevant, a qualified healthcare professional.

5. User Responsibilities

You agree to use Healther only for lawful purposes and in accordance with these Terms. The following are expressly prohibited:

• Reverse engineering, decompiling, or disassembling any part of the Service
• Scraping, crawling, or data-mining the Service by automated means
• Relying solely on the app for allergy or intolerance management without reading physical product labels
• Using Healther to manage or treat any medical condition without professional medical advice
• Commercially reselling or redistributing access to Healther Pro without our written consent - Healther Pro is licensed for personal use only
• Using the Service for any illegal, fraudulent, or harmful purpose
• Attempting to gain unauthorised access to any part of our infrastructure

6. Advertising

The free tier of Healther displays banner and interstitial advertisements powered by Google AdMob. Interstitial ads are shown after approximately every third scan.

• Ads may be interest-based, using your advertising ID (IDFA on iOS or Ad ID on Android) to serve relevant advertisements.
• To opt out of interest-based advertising, use your device's built-in controls: 'Limit Ad Tracking' or 'Allow Apps to Request to Track' on iOS; 'Opt out of Ads Personalisation' in Google Settings on Android.
• Healther Pro users are not shown ads within the app.

7. Purchases

Healther Pro is an optional one-time purchase that permanently removes in-app advertising. There are no recurring charges.

• Purchases are processed by Apple App Store (iOS) or Google Play (Android). We do not handle payments directly.
• Refunds are subject to the refund policies of Apple App Store or Google Play. We are unable to process refunds directly.
• If you reinstall Healther or switch devices, use the 'Restore Purchases' option within the app to re-activate your Healther Pro entitlement at no extra cost.
• RevenueCat is used to verify purchase entitlements. RevenueCat receives purchase receipts from the App Store or Google Play; we receive only your entitlement status.

8. Intellectual Property

The Healther application, its design, brand, features, and underlying technology are the exclusive property of Php4u Limited, protected by UK and international intellectual property laws. NutriScore is an EU-regulated trademark; its display in the app follows the official NutriScore licence conditions. Product data sourced from Open Food Facts is made available under the Open Database Licence (ODbL). Your use of the Service does not grant you any ownership rights in any part of the app or its content.

9. Third-Party Services

Healther integrates the following third-party services, each of which operates under its own terms of service and privacy policy:

• Open Food Facts - community food product database providing nutrition data
• Google Gemini Vision (via Firebase Cloud Functions) - AI product identification from photos
• Firebase Analytics and Firebase App Check - usage analytics and device attestation
• Google AdMob - in-app advertising on the free tier
• RevenueCat - in-app purchase management and entitlement verification

We are not responsible for the availability, accuracy, or practices of any third-party service. Your use of those services is governed by their respective terms.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, nor do we guarantee the accuracy, completeness, or reliability of any nutritional, allergen, or health-related information provided through the Service. Community- sourced product data from Open Food Facts may be incomplete or inaccurate, and AI-generated verdicts are estimates only.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Php4u Limited, its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including any harm arising from reliance on nutritional, allergen, or health information provided by the app.

In any case, our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amounts you have paid to Healther in the twelve months preceding the claim, or (b) fifty US dollars (USD $50).

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if required to do so by law. Upon termination, your right to use the Service will immediately cease. Because Healther does not maintain user accounts, you can remove all local app data - including your scan history and personal lists - by uninstalling the app from your device.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence grant you additional rights.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our practices. For material changes, we will provide at least 30 days’ advance notice by displaying a prominent notice in the app before the changes take effect. Continued use of the Service after the effective date of the revised Terms constitutes your acceptance. The current Terms will always be available at this URL with a revised effective date.
